Αναμφίβολα, ο θεσμός της διαμεσολάβησης τα τελευταία χρόνια ακολουθώντας τα όσα συμβαίνουν σε παγκόσμιο επίπεδο στη διαδικασία εναλλακτικής επίλυσης διαφορών κερδίζει έδαφος στην πατρίδα μας. Η χώρα στην οποία εφαρμόστηκε αρχικά στη σύγχρονη εποχή είναι οι Η.Π.Α με αμέσως επόμενες τη Νέα Ζηλανδία, την Αυστραλία και τη Μεγάλη Βρετανία. Στα πλαίσια της Ευρωπαϊκής Ένωσης μέσω της οδηγίας 2008/52/ΕΚ «για ορισμένα θέματα αστικής και εμπορικής διαμεσολάβησης» έχουμε τα πρώτα σπέρματα που άνοιξαν το δρόμο για τη καθιέρωση της διαμεσολάβησης στην Ευρώπη. Η Ελλάδα τώρα, ενσωμάτωσε την Ευρωπαϊκή οδηγία δύο χρόνια αργότερα με τον νόμο 3898/2010 «για την διαμεσολάβηση στις αστικές και τις εμπορικές υποθέσεις».
Αν και θα αναλυθεί σε κεφάλαιο στη συνέχεια, σε μια πρώτη προσέγγιση η διαμεσολάβηση είναι μία ευέλικτη αλλά και διαρθρωμένη διαδικασία υποβοηθούμενης διαπραγμάτευσης, όπου τα μέρη που διαφωνούν επιλέγουν ένα ουδέτερο τρίτο πρόσωπο το διαμεσολαβητή, ο οποίος τα βοηθά να καταλήξουν σε μια κοινά αποδεκτή εφαρμόσιμη συμφωνία.
Στο πρώτο κεφάλαιο θα προσπαθήσουμε να αποτυπώσουμε τις εναλλακτικές μορφές επίλυσης διαφορών, μέσα από μία ιστορική αναδρομή, την εμφάνισή τους ανά τους αιώνες στη χώρα μας αλλά και στη συνέχεια στην εποχή μας.
Στο δεύτερο κεφάλαιο θα ορισθεί ως έννοια, θα διατυπωθούν οι αρχές , η διαδικασία και τα πλεονεκτήματα της διαμεσολάβησης καθώς και ο ορισμός της έννοιας της διαιτησίας αλλά και η σύγκρισή της με τη διαμεσολάβηση.
Στο τρίτο κεφάλαιο θα ερευνηθούν οι τύποι, οι μορφές, οι αιτίες, οι συνέπειες και οι τρόποι αντιμετώπισης της σύγκρουσης στους Ο.Τ.Α.
Στο τέταρτο κεφάλαιο θα προσπαθήσουμε μέσα από ένα ερωτηματολόγιο να διερευνήσουμε τις συγκρούσεις που λαμβάνουν χώρα στο Δήμο Λαρισαίων και το ρόλο της διαμεσολάβησης ως ένα πιθανό τρόπο επίλυσής τους.
Abstract
Following what is happening globally in the process of alternative dispute resolution, the Institution of Mediation is undoubtedly gaining ground in our country in recent years. The country in which it was first introduced in modern times is the United States, followed by New Zealand, Australia and the United Kingdom. Τhe first seeds that paved the way for the establishment of mediation in Europe appear in the Framework of the European Union, through Directive 2008/52 / EC "On certain issues of civil and commercial mediation". Greece has now incorporated the European directive into the law of 3898/2010 "On Mediation in Civil and Commercial Cases". Although it will be discussed in more detail later, in the first approach mediation is a flexible but structured process of assisted negotiation where the parties in dispute choose a neutral third party mediator, who helps them reach a mutually acceptable and? applicable agreement.

In the third chapter, the types, forms, causes and consequences of conflict are examined as well as ways to deal with it.
In the fourth chapter, there appears an effort to investigate the conflicts that take place in the Municipality of Larissa and the role of Mediation as a possible way to solve them. The issue is approached through a questionnaire. | en_US |
